Terms of Use

These terms are the agreement between you and TourIts for using the app. TourIts gives you practical travel information, but fairness verdicts, recording-law guidance, travel times and translations are informational only and not financial, legal or professional advice. Please use the app lawfully, keep reviews honest and respect other people.
1. About these terms
These Terms of Use (“Terms”) govern your use of the TourIts mobile app and related services (the “Service”), operated by Liam Abu, an individual based in Israel (“TourIts”, “we”, “us”). By downloading, accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
The Subscription & Billing Terms, Community & Review Guidelines, Recording & Consent Notice and Privacy Policy form part of these Terms.
2. Eligibility
You must be at least 16 years old (or the higher minimum age in your country) to create an account. If you use the Service on behalf of someone else, you confirm you are authorised to do so. Younger people may use the Service only under the supervision of a parent or guardian, without creating an account.
3. Accounts and guest use
- You may use many features as a guest. Guest data is stored only on your device and is deleted automatically 7 days after first use.
- If you create an account, you must provide accurate information and keep your password confidential. You are responsible for activity under your account.
- Tell us immediately at support@tourits.app if you believe your account has been accessed without permission.
- You may delete your account at any time in Settings.
4. Licence to use the app
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your personal, non-commercial use. The app is licensed, not sold. Apple’s and Google’s standard terms for apps distributed through their stores also apply; if they conflict with these Terms on the rights of the store provider, the store terms prevail for that point.
5. Acceptable use
You agree not to:
- break any law, including laws on recording conversations, privacy and consumer protection;
- record anyone without the consent required by local law, or use recordings to harass, threaten or embarrass anyone;
- post fake, paid-for, retaliatory or misleading ratings or reports, or rate places you have not visited;
- post content that is unlawful, defamatory, hateful, harassing, sexually explicit, or that reveals someone’s personal information;
- scrape, copy or bulk-extract data from the Service, or use it to build a competing database;
- reverse engineer, interfere with or overload the Service, or bypass usage limits or paywalls;
- impersonate any person or misrepresent your affiliation;
- use the Service for commercial purposes without our written permission.
6. Your content (reviews, ratings and reports)
You keep ownership of the ratings, comments, store reports and other content you submit (“User Content”). By submitting User Content you grant TourIts a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt (for example translate or aggregate), display and distribute it in connection with operating and improving the Service. This licence continues for aggregated or anonymised data after you delete your account.
You confirm that your User Content is honest, based on your own experience and does not infringe anyone’s rights. We may moderate, refuse or remove User Content that breaks these Terms or our Community & Review Guidelines, but we are not obliged to monitor all content.
7. Change Helper: fairness verdicts are information, not financial advice
The Change Helper compares an offer with the mid-market exchange rate supplied by a third-party provider and labels it (for example “Fair deal” or “Tourist trap”) using fixed percentage bands. Rates may be delayed, incomplete or inaccurate, and real-world prices legitimately vary. Verdicts are general information to help you decide; they are not financial advice, a recommendation to transact or a statement that any business acted unlawfully. You remain responsible for your decisions and for counting money you receive. Store fairness scores reflect other users’ reports and may not represent current conditions.
8. Recording-law information is not legal advice
The app shows general information about whether recording a conversation may require consent in a country, and adjusts its behaviour (such as asking the clerk to tap OK) accordingly. This information is compiled from public sources, may be incomplete, out of date or wrong, and is not legal advice. You are solely responsible for complying with the laws that apply to you when recording. When in doubt, ask for consent or do not record.
9. Maps, places, travel times and translations
Map data, opening hours, place details, “App picks”, travel time estimates and translations are provided for general information and may be inaccurate or incomplete. Travel times do not account for traffic, closures, weather, accessibility or safety conditions. Translations are machine-generated and may contain errors; do not rely on them for medical, legal, safety-critical or other important matters. Always use your own judgment, follow local signs and laws, and check critical information with official sources. TourIts is not an emergency service; in an emergency, contact local emergency services.
10. Third-party services and links
The Service may link to or open third-party apps and websites, such as Google Maps, Apple Maps, Waze, booking and ticketing sites. We do not control them and are not responsible for their content, availability, prices or practices. Bookings and purchases you make with third parties are agreements between you and them. Some links may be affiliate links from which we may earn a commission at no extra cost to you.
11. Subscriptions
Some features require a paid Plus or Pro subscription. Subscriptions are purchased through the App Store or Google Play and are governed by the Subscription & Billing Terms. In test and beta builds, purchases may run in test or sandbox mode; then no charges are made and test access may be changed or reset at any time.
12. Intellectual property
The Service, including its design, software, text, graphics, logos and the TourIts name, is owned by TourIts or its licensors and is protected by intellectual property laws. Third-party data and open-source components are used under their own licences, listed in Open-source & Data Attributions. Except as these Terms allow, you may not copy, modify or distribute any part of the Service.
13. Availability and changes to the Service
We work to keep the Service available but do not guarantee it will be uninterrupted, error-free or available in every country. We may add, change or remove features, including features that depend on third-party providers. If we remove a significant paid feature during a subscription period you paid for, we will tell you and, where required by law, offer an appropriate remedy.
14. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. Nothing in these Terms limits rights you have as a consumer that cannot be excluded under applicable law.
15. Limitation of liability
To the maximum extent permitted by law, TourIts is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, money, data or opportunities, arising from your use of the Service, including losses from currency exchanges, missed connections, bookings or reliance on translations. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. These limits do not apply to liability that cannot be limited by law, such as for death or personal injury caused by negligence, fraud, or (for consumers in the EU/UK) gross negligence or intentional misconduct.
16. Indemnity
Where permitted by law, you agree to indemnify TourIts against claims arising from your User Content, your recordings, or your breach of these Terms or of any law, except to the extent caused by our own fault.
17. Suspension and termination
You may stop using the Service at any time and delete your account in Settings. We may suspend or close accounts, or remove content, if you seriously or repeatedly breach these Terms, if required by law, or to protect users or the Service. Where reasonable, we will tell you why and give you a chance to respond. Sections that by their nature should survive termination (such as User Content licences for aggregated data, disclaimers and liability limits) continue to apply.
18. Changes to these Terms
We may update these Terms. We will give reasonable notice of material changes in the app or by email. If you keep using the Service after changes take effect, you accept the updated Terms; if you do not agree, you should stop using the Service and may delete your account.
19. Governing law and disputes
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. Subject to the next sentence, the competent courts of Tel Aviv-Jaffa, Israel, have exclusive jurisdiction over any dispute arising from these Terms or the Service. If you are a consumer, you also benefit from any mandatory protections of the country where you live, and you may bring proceedings in the courts of the place where you live where the law gives you that right. Before starting proceedings, please contact us at support@tourits.app so we can try to resolve the issue informally.
